The article deals with the concept of unjust damage. The Author, starting from the historical literature (subsequently superseded by the leading case Meroni and, even earlier, by a doctrine that hoped to overcome the paleo-ownership thesis), focuses his attention on the topicality of this concept, taking into account the case law. From the Superga case to the recent one on the subject of bullying, it’s possible to draw the lesson according to which the unjust damage constitutes a stitch between the Constitution and the tort-law
