The article deals with the concept of unjust damage. The Author, starting from the historical literature (subsequently superseded by the leading case Meroni and, even earlier, by a doctrine that hoped to overcome the paleo-ownership thesis), focuses his attention on the topicality of this concept, taking into account the case law.
