Questo saggio risale alle origini della scrittura del diritto, utilizzata originariamente per disciplinare situazioni che le consuetudini non riescono più a governare una volta venuto meno il consenso su di esse. La scrittura del diritto è sin dalle origini legata allo spazio magico-simbolico della religione e per tale via svolge una funzione performativa della realtà. Tale forza della scrittura si conserva anche in epoca moderna e contemporanea, nella scrittura delle carte costituzionali, che assolvono il compito di superare situazioni di crisi e di dettare le regole di un ordine nuovo, proprio facendo leva sul suo valore simbolico. A conferma di ciò si può osservare che, anche in un contesto tradizionalmente restio alle regole costituzionali scritte come quello inglese, innanzi a passaggi storici nevralgici si è fatto ricorso alla scrittura.
